Terms of Service
1. Acceptance
By creating a NugLab account or using the service at nuglab.app / grower.nuglab.app, you agree to these Terms. If you do not agree, do not use the service.
2. Service Description & Legal Use
NugLab is a grow tracking and monitoring application for indoor plant cultivation. By using NugLab, you confirm that your use complies with all applicable laws and regulations in your jurisdiction, including any legislation governing plant cultivation. NugLab does not endorse or facilitate illegal activity.
3. Account
You must provide a valid email address and be at least 18 years old. You are responsible for maintaining the confidentiality of your account credentials. You agree not to share your account with others or create accounts on behalf of third parties without their consent.
4. Subscriptions and Billing
- Subscriptions are billed monthly in advance via Stripe.
- The Free plan requires no credit card.
- A 14-day Premium trial is offered to new accounts at no cost.
- You may cancel at any time; cancellation takes effect at the end of the current billing period. No refunds are given for partial months.
- NugLab reserves the right to modify pricing with 30 days' notice by email.
5. Your Content
Your grow data (diary entries, sensor readings, photos) belongs to you. NugLab processes it solely to provide the service and improve it in an aggregated, anonymised form. On account deletion, your personal data is removed within 12 months except where retention is required by law. You may export your data at any time from the app settings.
6. Acceptable Use
You may not: reverse-engineer or decompile the service; scrape or resell sensor data commercially; attempt to gain unauthorised access to other users' data; use the service to send spam or malicious content; or use automated scripts against the API beyond the rate limits specified for your plan.
7. Intellectual Property
All software, design, trademarks and content of the NugLab service are the exclusive property of Daniele Pisu / NugLab, or used under licence. Nothing in these Terms grants you any rights in NugLab's intellectual property other than the limited right to use the service.
8. Service Availability
NugLab aims for 99.5% monthly uptime. No SLA is guaranteed on the Free plan. Planned maintenance will be announced by email with reasonable advance notice. We are not liable for downtime caused by third-party infrastructure (Supabase, Vercel, Stripe).
9. Limitation of Liability
The service is provided "as is" without warranties of any kind. Daniele Pisu / NugLab is not liable for indirect, incidental or consequential damages, loss of profits, or data loss arising from use of or inability to use the service. Maximum liability in any event is limited to the amount paid by you in the three months preceding the event giving rise to the claim.
10. Governing Law and Jurisdiction
These Terms are governed by Spanish law. Any disputes shall be resolved in the courts of Santa Cruz de Tenerife, Canary Islands, Spain, to whose jurisdiction both parties submit.
11. Changes to These Terms
We may update these Terms. Material changes will be notified by email at least 15 days before taking effect. Continued use of the service after the effective date constitutes acceptance.
